Hershey Entertainment wins another trademark fight, forces hotel to change its name - PennLive.com

Hershey Entertainment & Resorts Company has just won another of its semi-frequent federal trademark infringement battles.

This time, the victory has purged the name "Milton" from a Hershey-area hotel.

And it came rather swiftly.

The fight began in June when Hershey Entertainment filed suit in U.S. Middle District Court against Milestone Hotel Partners LLC, owners of what was then called The Milton Hotel at Route 422 and Sipe Avenue.

Hershey Entertainment claimed Milestone had violated its trademarks by using the name of chocolate magnate Milton S. Hershey, who put Hershey on the map as a world-renowned tourist destination.

In its lawsuit, Hershey Entertainment sought a court order requiring Milestone to change the Milton's name, purge any Hershey trademarks from its advertising, sign over the domain name for its website and pay unspecified triple damages on any profits it amassed by the alleged infringement.

On Wednesday, attorneys for Hershey Entertainment and Milestone filed a notice with Chief Judge Christopher C. Conner that a settlement of the dispute had been reached. Julian E. Neiser, an attorney for Hershey Entertainment, declined comment on the deal Thursday morning.

However, one element of the settlement is fully evident. Milestone already has renamed The Milton. It is now the Red Lion Inn & Suites Hershey.

The battle over The Milton Hotel's name followed a familiar pattern. The targets of Hershey Entertainment's trademark infringement suits tend to fold before a judge has to make a ruling on the case.
